These Terms & Conditions (the “Terms”) govern your use of Booknow, the appointment scheduling service operated by Apollo Technology Global LLC, Fargo, North Dakota, USA (“Booknow”, “we”, “us” or “our”). They apply to our website at book-now.app, the business portal, the Booknow mobile app and the booking pages we host for businesses (together, the “Service”).
Booknow subscriptions renew automatically. Please read these Terms before you start a free trial or buy a subscription. To avoid being charged for the next period, cancel before your trial or subscription renews.
Acceptance of these Terms
By creating an account, starting a free trial, buying a subscription or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a business, you confirm that you are authorised to accept these Terms for that business, and “you” includes the business.
If you do not agree to these Terms, do not use the Service.
The Service
Booknow helps service businesses manage appointments: a shared calendar, services and prices, team members and their working hours, customer records, a public booking page, booking confirmations and reminders by email and text message, and customer reviews.
Customers can book with a business on its booking page without creating an account. Each business decides which services, times and team members it offers. Booknow is not a party to the appointments made through the Service.
Accounts
You need an account to use the business portal or the mobile app. You must be at least 18 years old, give accurate and complete information, and keep it up to date.
You are responsible for keeping your sign-in details confidential and for everything that happens under your account, including what the team members you invite do. Tell us straight away at support@book-now.app if you believe your account has been used without your permission.
Sign-in and account management are provided through our account and billing platform. We may suspend or close accounts that break these Terms.
Subscriptions and payments
Booknow is offered on paid subscription plans. The plans, prices, billing periods and any free trial available to you are shown before you subscribe. Taxes are added where required.
Payments are processed by our payment processor. We do not store your full card details.
Your subscription renews automatically at the end of each billing period, at the price in effect at that time, until you cancel. We will tell you about any price change in advance, and it applies from your next billing period.
If a payment fails or your subscription ends, you can still sign in and view your data, but you cannot make changes until your subscription is active again.
Free trials
If your plan includes a free trial, you can use the Service free of charge for the trial period shown at sign-up. Unless you cancel before the trial ends, your paid subscription starts automatically when it does.
Cancellation and refunds
You can cancel your subscription at any time in the business portal. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Payments are non-refundable, and we do not give refunds or credits for partial billing periods, except where the law requires otherwise. If you believe you were charged by mistake, contact us at support@book-now.app and we will reply within two business days.
Your business data and your customers
You keep all rights to the data you and your customers enter in the Service, such as services, schedules, customer details and appointments (“Business Data”). You allow us to store, process and display Business Data only to provide, secure and improve the Service for you.
For your customers’ personal data, you are the controller and we process it on your behalf, as described in our Privacy Policy. You are responsible for having a lawful basis to collect it, for telling your customers how you use it, and for answering their requests about it.
Booknow sends booking confirmations, reminders and review requests to your customers by email or text message on your behalf. You are responsible for making sure you may contact your customers this way, including getting any consent the law requires for text messages. We cannot guarantee that every message will be delivered.
Acceptable use
When you use the Service, you must not:
- break any law or anyone’s rights, including privacy and intellectual property rights;
- send spam or messages your customers have not agreed to receive;
- upload content that is unlawful, misleading or offensive, or that you do not have the right to use;
- try to access accounts, data or systems that are not yours, or interfere with the security or operation of the Service;
- copy, resell or reverse engineer the Service, or access it by automated means other than the features we provide;
- make bookings in someone else’s name without their permission.
We may remove content or suspend access if we reasonably believe these rules have been broken.
Intellectual property
The Service, including its software, design, logos and content, belongs to Booknow or its licensors and is protected by law. We give you a limited, non-exclusive, non-transferable right to use the Service for your business while your subscription is active.
When you upload content such as your logo, photos or descriptions, you keep ownership of it and allow us to host and display it, including on your public booking page, so that we can provide the Service.
Third-party services and links
The Service relies on third-party providers, for example for payments, maps, text messages and email delivery, and may link to other websites. We are not responsible for third-party websites or services, which have their own terms.
Changes to the Service
We keep improving Booknow and may add, change or remove features. If a change significantly reduces the Service you pay for, we will tell you in advance.
Disclaimer
The Service is provided “as is” and “as available”. To the extent permitted by law, we make no warranties of any kind, including that the Service will be uninterrupted, error-free or suitable for a particular purpose.
Limitation of liability
To the extent permitted by law, Booknow is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or bookings, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
Indemnification
You agree to defend and indemnify Booknow against claims, losses and costs (including reasonable legal fees) arising from your Business Data, from your use of the Service in breach of these Terms, or from your dealings with your customers.
Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we stop offering the Service, in which case we will give you reasonable notice where we can.
Sections that by their nature should survive termination, such as payments, intellectual property and limitation of liability, continue to apply.
Governing law and disputes
These Terms are governed by the laws of the State of North Dakota, USA, without regard to its conflict-of-law rules. Before starting formal proceedings, please contact us so that we can try to resolve the issue informally.
Any dispute that cannot be resolved this way will be brought before the state or federal courts located in North Dakota. If you are a consumer and the law of your country gives you the right to bring claims before your local courts, that right is not affected.
Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the “Last updated” date, and we will tell you about significant changes by email or in the Service before they take effect. If you keep using the Service after that, you accept the updated Terms.
